COMMITTEE ON COLLEGE AND UNIVERSITY ELECTIONS AMOUNTED TO JUDICIAL LEGISLATION SHANTARAM NAIK ,MP Goa

Union Minister of State in the Ministry of Human Resource Development Mrs. D.Purandeshwari informed Mr Shantaram Naik M.P. in a written reply in the Rajya Sabha today that the Supreme Court is of the opinion that the appointment of J.M.Lyngdoh Committee, earlier made by the court amounted to judicial legislation and hence, the matter has been referred to a five member constitution bench of the Supreme Court.

Lyngdoh Committee which was constituted by the Supreme Court had made several recommendations regarding university and college students elections, imposing a number of restrictions, however by their order dated 11th November 2009, the very apex court found a need to review the Judgement.

To the question of Mr Naik about the stand taken by the government in this regard the minister informed Mr Naik that since the government has not received the notice in this case yet, revealing of governments stand at this stage, does not arise.

In another written reply Mrs Purandeshwari informed Mr Naik that a legislation to punish the malpractices by higher educational institutions is under the consideration of the Government.
