Goa: ‘Our legal system should meet requirements of the 21st century’

The Commissioner for NRI Affairs, Mr Eduardo Faleiro, on Saturday, stated that the society is undergoing a rapid transformation and it is necessary that our legal education system should meet the requirements of the 21st century.
Urging for an analysis of the new Portuguese Civil Code of 1966, Mr Faleiro, however, cautioned that foreign laws can be transferred to the extent that they reflect the social realities of the recipient country itself. The Commissioner for NRI Affairs was speaking after felicitating Professor V B Coutinho, director of the Directorate of Legal Education, Bar Council of India, who is also former Dean of Bangalore University and former Vice Chancellor of Gulbarga University at a function organized by V M Salgaocar College of Law, Panaji in the college conference hall on Saturday. Speaking further, he said the conventional role of a lawyer is to step in after the event to resolve disputes and dispense justice to the aggrieved party.

"In the present scenario, it is envisaged that legal education should also provide training for policy planers, business advisors, mediators among interest groups, negotiators, lobbyists, etc," he added. These roles, the Commissioner for NRI Affairs said demand specialised knowledge and skills not presently available within the existing legal education system in India. Mr Faleiro also said that the Directorate of Legal Education has been established recently by the Bar Council of India as per the recommendations of the Supreme Court. "The directorate has been created to suggest reforms and improve the standard of legal education in India. It will bring under its umbrella about 950 law colleges," he added.

Prof V B Coutinho, he said, is an eminent Goan, who has done pioneering work in the filed of legal education. "As Vice Chancellor of the Gulbarga University he became the first Goan to be the Vice Chancellor of an Indian University."
He is the ideal person to head the Directorate of Legal Education in view of his outstanding scholarship and vast experience in the field of legal education, Mr Faleiro said. Speaking on the occasion, Prof Coutinho stated that he is privileged to lead this directorate and for being appointed by the Supreme Court. Expressing happiness that the Salgaocar college is one of the best law institutes in the country, he said that his endeavour would be to bring all the 950 law colleges in the country to the level of A grade.

He further said that the state of legal education in the country needs to be improved and therefore the Bar Council would conduct courses for young advocates by bringing legal experts and experts from the foreign countries and even by video conferences so that the standard and confidence level of our Indian advocates is raised. "Under this we are focusing on training the young lawyers. The training programmes would start in four zones and the first one would be in Goa. It will start in November, focusing on criminal laws, practice and technology. It will be an eight-day programme and would be attended by 100 advocates. We are getting experts from places like Howard and have finalized Rs 65 crore budget for it," he added.

Prof Coutinho also said that the law graduates who pass out in the year 2010 will have to undergo a test to get themselves registered with the Bar Council. He also suggested that all law colleges should focus on state relevant laws.
